Tea estates to get refund of cess collected since 2004

The tea cess which was collected since 2004 will be refunded to tea estates across the India. This involves substantial money. The Director, Central Board of Excise and Customs, Department of Revenue of the Finance Ministry clarified that collection of such cess was not in accordance with the rules. The tea estates are yet to get the refund despite the order was circulated in January this year.

The department has suggested TAI to advise the members to file claim before the jurisdictional central excise authorities as contained in sec 11B of the central excise Act 1944.

The department has directed to stop collection of the education cess and the secondary and higher education cess on tea cess under the Tea Act, 1953 from the tea producers and to make necessary arrangements for refund of education cess and the secondary and higher education cess so far collected from the tea producers.
