Third HC judge’s verdict upholds appointment of lokayukta in Gujarat

Amidst the election season, High Court of Gujarat has decided to uphold the appointment of RA Mehta as the lokayukta by Governor Kamla Beniwal, which has jolted the state government. Narendra Modi government which was aiming high for Gujarat's polls in Nov-Dec 2012 has reacted citing that “the governor's move to appoint the Lokayukta was arbitrary and has been rejected.”

The petitioners cheering the HC decision termed it as a historic judgment.  The hearing was completed on December 29, 2011 and verdict was announced today by Justice V.N. Sahai, who was the third judge hearing the petition. Prior to this, Justice Akil Kureshi had upheld the appointment of Mehta while Justice Sonia Gokani disagreed. 'There was a difference of opinion in the two-judge bench and today the verdict of the third judge came and he said he agrees with the view of Justice Kureshi,' petitioner Anand Yagnik said.

The post of Lokayukta had been lying vacant since last eight years till August 2011 when retired Justice R A Mehta was appointed by Gujarat governor Kamla Beniwal. However, Gujarat government leaving no stone unturned strongly opposed the appointment the very next day in HC as well as campaigned against the Governor.
