Supreme Court’s verdict triumphs Swamy’s petition; setback for the govt

Amidst the election season ruling government has been once again red faced; today Supreme Court has given verdict in favour of Subramanian Swamy directing Prime Minister’s office for setting a three-month deadline to sanction application(s) seeking prosecution of a public servant for corruption. The verdict by SC is considered as victory for the Indian Constitution also has restored belief of nationals that win against corruption is possible especially after seeing the highly publicized draft Lokpal Bill getting buried under the heap of files.

The petitioner and Janata Party president -- Subramanian Swamy with others cheered the verdict and said 'I am happy today by the fact that I visualise that it is possible to win war against corruption. The thorniest issue of sanction (to prosecute a corrupt official) has been simplified by the court order.'

Earlier, the sanction from Prime Minister’s office to prosecute against public service was a major blockade. In the 2G scam, PMO took 16 months to sanction the prosecution against tainted former telecom minister A Raja; however, post the order, government can take not more than 3-months to grant its consent and may take additional one more month if it consults Attorney General. Thus, maximum delay of four months can be entertained, beyond which it will be treated as deemed sanction.
