2G Scam: Delhi Court exempts corporate honchos from personal appearance

The 2G spectrum scam accused corporate honchos have heaved a sigh of relief today when the Delhi court granted them exemption from personal appearance which had earlier summoned them. The relieved accused included Essar group promoters Ravikant Ruia, Anshuman Ruia and Loop Telecom’s IP Khetan and Kiran Khetan. However, to move a bail plea for Ruias, Vikas Saraf, director, Essar group appeared before the court. While, Khaitans cited their “poor health” condition as additional ground in support of their exemption pleas.

Observing the submission by Special Public Prosecutor U U Lalit which stated no objection from the investigating agency CBI on the bail plea, Judge O P Saini said “Exemption applications of four accused (Ruias and Khaitans) are allowed for today only.” The court will hear the matter on March 17, 2012.

On December 12, 2011, the CBI had filed its third charge sheet in multi-crore 2G scam of which court had taken cognizance and issued summons to the five accused and three companies. Fresh summons were issued to these accused who didn’t turn up stating the summon order was not “duly” served on them. On February 15, 2012, the apex court refused to grant interim stay on the order, however, it accepted their pleas wherein they challenged the jurisdiction of the special CBI court. The telecom firms are booked under section 420 (cheating) and 120B (criminal conspiracy) of the IPC.
