Excel Crop Care slapped with penalty amounting Rs 63.90 by the CCI

Excel Crop Care has been levied with a penalty amounting to Rs 63.90 crore by the Competition Commission of India (CCI) vide its order dated April 23, 2012 under section 27 of the Competition Act, 2002. The order was passed in a proceeding against the Company and three other manufacturers of Aluminium Phosphide Tablets. CCI concluded that the provisions of section 3(3) (b) and 3(3)(d) of the Competition Act, 2002 have been violated.

However, the company proposes to challenge the said order of the Commission by filing an appeal before the Competition Appellate Tribunal.  

United Phosphorus, Excel Crop, along with two more manufacturers, have been accused of colluding while submitting bids for a tender for aluminium phosphide tablets from Food Corporation of India. CCI imposed a penalty of 9 percent of the average of their standalone turnover over the past three years
