Govt may introduce Land Acquisition Bill in current session of parliament

The government may introduce the much awaited Land Acquisition Bill which targets to protect the interests of farmers, in the current monsoon session of Parliament, the Rural Development Minister Jairam Ramesh said, 'the Bill is in public domain to get suggestions and comments. I am in touch with the chief ministers of states and also leaders of political parties... Hopefully we will bring the bill in this session only.”

However, government is in dilemma whether to execute the Land Acquisition and Rehabilitation and Resettlement Bill retrospectively or from prospective date. 'Normally this is implemented from prospective date...I have received some suggestions saying it should be done retrospectively with cut-off date. We will consider all suggestions before taking a decision,' Jairam said.

The land acquisition act lays out three situations when it would apply; these are when the government acquires land for its own use, hold and control; when the government acquires land for the future use of a private firm for a stated public purpose; and when it acquires land for a private firm for an immediate public purpose.

Jairam Ramesh said that the bill will not only protect the interests of farmers and owners of the land but also those whose livelihood is dependent on this land. However, the bill does not stop private parties from buying land for private purposes. With reference to the controversy on acquiring land for public purpose but diverted for other, Jairam Ramesh said, '...public purpose is very broad. In my opinion public purpose is development of infrastructure, railways, roads and highways and not malls and shopping complexes.'

As per the draft new Land Acquisition Bill, in rural areas the compensation will be six times the registered sale price and it will be twice more for people in urban areas whose land is acquired. The consent of 80 per cent of the people of the area where land is to be acquired will also become mandatory. The new Land Acquisition Bill is also compliant with all existing laws on tribal welfare. The process of acquisition is also made fully transparent.

The Land Acquisition Act was introduced in 1894 by the colonial rule. Presently, the Land Acquisition Act look over the process of acquiring land for development proposes. However, in recent time, government had faced stiff opposition from local communities and famers for acquiring land for industrial propose.  Some of the worst disputes have occurred when the government facilitated land acquisition for large-scale industrial projects that were billed as likely to bring development and factory jobs to poor areas. These include the protests around Tata’s planned Nano car factory in West Bengal that the company eventually moved to the state of Gujarat, and South Korean firm Posco’s proposed steel plant in eastern Orissa state.
