Relief for Chidambaram on 2G case: Supreme Court dismisses Swamy’s plea

In a big relief to the UPA government, the Supreme Court (SC) on Friday, dismissed Janata Party chief Subramanian Swamy's plea by declaring that no case is made out against Union Finance Minister P.Chidambaram in the 2G spectrum allocation scam, as all the material records failed to prove his corruption or illegal motives or in abuse of his official position. Swamy expressed his allegation on to the judgment and stated it as bad judgment.

Earlier on 2 February, a special court was made responsible by SC to decide on Swamy’s plea to try Chidambaram in the case and on February 4 this year, Delhi court had dismissed a plea of a co-accused in the 2G case, as Chidambaram did not indulge in any criminal conspiracy or derive any pecuniary advantage in the decisions taken with Raja. This is for the second time a judicial relief has come for Chidambaram. 

The court after considering all the material on record concluded that there was no deliberate act or abuse of position by Chidambaram, in relation to the 2G scam and there was no case or evidence that could sufficiently infer criminal conspiracy between Chidambaram and A Raja and at the time of controversial allocation of 2G spectrum in 2008, the Finance Minister was the only party to two decisions, i.e. keeping spectrum prices at 2001 level and dilution of equity by two companies, which was “not per se criminal”.
