SC dismisses Sangma's petition, calls it ‘not maintainable’

Former Lok Sabha speaker PA Sangma's petition challenging Pranab Mukherjee's election as the President of India has been dismissed by the Supreme Court (SC), saying it is not maintainable. The apex court special bench, headed by Chief Justice Altamas Kabir, by a majority judgement, rejected the petition by defeated presidential candidate P A Sangma, who had contended that Mukherjee held an office of profit when he had filed his nomination papers.

On November 21, Supreme Court had reserved its verdict for December 5 as to whether the plea of Sangma deserves a regular hearing or not. However, during the arguments by Mukherjee's lawyer Harish Salve and Attorney General GE Vahanvati, Jethmalani said the court was required to see as to whether the petition raised any cause of action or not.

Salve during his arguments before the bench, also comprising justices P Sathasivam, SS Nijjar, J Chelameswar and Ranjan Gogoi, said the petition was frivolous and a fit case to be dismissed and said that hence can request for minutes of the meeting from the Congress Working Committee (CWC) which held a special farewell for Mukherjee, then poised to become the President.
