Maharashtra political crisis: SC refers petitions filed by Shiv Sena, Eknath Shinde to constitution bench

The Supreme Court (SC) today said petitions relating to the political dispute in Maharashtra between Shiv Sena factions led by Uddhav Thackeray and Chief Minister Eknath Shinde, will be heard by a 5-judge Constitution bench on Thursday, August 25. The pleas are several constitutional questions related to defection, merger and disqualification of MLAs.

A bench headed by Chief Justice N V Ramana ordered the listing of petitions before the constitution bench on Thursday and directed the Election Commission not to pass any orders on Shinde faction's plea claiming for the party’s election symbol ‘bow and arrow’. A bench also includes Justices Krishna Murari and Hima Kohli.

The bench was hearing pending cases related to the recent political crisis in Maharashtra that led to the fall of the Maha Vikas Aghadi (MVA) government in the state. Eknath Shinde and 39 other Shiv Sena MLAs deserted the Thackeray camp and formed the government on in Maharashtra with the support of the BJP.
