Allahabad High Court dismisses PIL alleging Rahul Gandhi's dual citizenship

The Lucknow Bench of the Allahabad High Court today dismissed the Public Interest Litigation (PIL) alleging that Congress MP and Leader of Opposition in the Lok Sabha, Rahul Gandhi, holds dual citizenship of India and the United Kingdom.

The Public Interest Litigation (PIL) was filed by BJP worker S Vignesh Shishir from Karnataka, claiming that ‘Rahul Gandhi is also a citizen of the United Kingdom and is ineligible to be a member of the Lok Sabha.’ It further stated that ‘Gandhi’s alleged citizenship of another country contravenes with Indian law, which does not permit dual citizenship.’

In response to this claim, the Lucknow Bench directed the Central Government to provide details of the actions taken so far in addressing the issue of Rahul Gandhi’s citizenship status. However, the court was not happy with the report submitted by the MHA. It said that the report failed to directly address whether Gandhi is an Indian citizen or not. During the hearing, the MHA told the court that it needed more time to verify information from the UK government.

This matter about Rahul Gandhi’s citizenship is not new. In 2019, the MHA sent a notice to Gandhi after Rajya Sabha MP Subramanian Swamy complained that Backops Limited, incorporated in the UK in 2003, had Gandhi as one of its directors and secretaries. In his complaint, Swamy pointed out that Gandhi had declared himself as a British citizen in the company’s official documents. Specifically, the company’s Annual Returns, filed in 2005 and 2006, listed as British.
