Modi govt introduces Lokayukta Aayog Bill, 2013 in Assembly

Unhappy with the Supreme Court order, upholding Justice (retired) RA Mehta's appointment as the Lokayukta of Gujarat, the Narendra Modi government has introduced Lokayukta Aayog Bill, 2013 in the Gujarat Assembly, which curtails the 'primacy' of the Chief Justice of the state High Court and the Governor in the matter of appointment of the Lokayukta.

The bill proposes to give all the powers of the appointment to a selection committee headed by Chief Minister and wants state Governor to act on the recommendations of this committee. According to the bill, the Lokayukta will have to seek the government’s permission before acting on a complaint. If a complaint is found to be frivolous, the complainant will have to deposit Rs 2,000 to Rs 25,000 as a fine and may be jailed upto six months.

Supreme Court had ruled that primacy of the opinion of Chief Justice of the High Court in the Lokayukta Act was final. The new Bill also proposed a special provision which gives pivotal power to the state government in excluding any 'public functionaries' from the jurisdiction of the Lokayukta.
