Supreme Court fixes one month deadline for overstaying officials

The Supreme Court today fixed a one-month deadline to vacate the official accommodation, for ministers, MPs, judges and bureaucrats after retiring or demitting government office. This concern was expressed by a bench of justices P Sathasivam and Ranjan Gogoi suggesting that a notice of three months should be given to the officials to vacate the premises and reasonable force can be applied against them if only they refuse to leave the accommodation.

The bench said that it was unfortunate to remain in official accommodation beyond entitlement as it high-jacked the rights of other person to whom it was to be allotted. A slew of guidelines have been made for procedures against the illegal occupants by the bench. The Speaker of Lok Sabha and Chairman of Rajya Sabha would initiate proceedings against MPs for breach of privilege. However, in some special circumstances, the time period can be extended by another one month.
